1. Acceptance of Terms
By downloading, installing, accessing, or using DrawRing: Chain Drawing (the "App"), you agree to be bound by these Terms of Service ("Terms"). These Terms are a legal agreement between you and Justin Sun ("we", "us", or "our"). If you do not agree to these Terms, do not use the App.
2. Description of Service
DrawRing: Chain Drawing is a collaborative drawing application that allows users to create and participate in drawing chains. Users can create drawing prompts, invite others to contribute via invite codes, and view completed collaborative artworks. The App is designed for private, direct sharing between users and does not feature a public global gallery.
3. Age Requirements
You must be at least 4 years old to use DrawRing: Chain Drawing. If you are under 18, you represent that you have your parent's or guardian's permission to use the App and that they have agreed to these Terms on your behalf.
4. User Accounts
4.1 Anonymous Authentication
DrawRing: Chain Drawing uses anonymous authentication. You do not need to provide an email address or phone number to create an account; your account is tied to your specific installation of the App.
4.2 Account Responsibility
You are responsible for all activities that occur under your anonymous session. You agree to notify us immediately of any unauthorized use of your account.
4.3 Data Persistence & Account Loss
Important: Because accounts are anonymous and stored locally on your device, we cannot recover your account, drawing history, or active chains if you delete the App, clear your app data, or lose your device. By using the App, you acknowledge that your data may be permanently lost in these events.
5. User-Generated Content
5.1 Content Ownership & License
- Your Contribution: You retain ownership of the specific artistic contribution you make to a chain.
- Collaborative License: You acknowledge that a completed Drawing Chain is a collective work. By contributing to a chain, you grant other participants in that chain a non-exclusive, worldwide, royalty-free, perpetual license to view, display, and share the completed collaborative image.
- License to Us: You grant DrawRing: Chain Drawing a worldwide, non-exclusive, royalty-free license to use, host, and display your content solely for the purpose of operating and providing the App's services.
5.2 Content Standards
You agree not to create, upload, or share content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
- Contains hate speech, discrimination, or promotes violence
- Is sexually explicit, pornographic, or obscene
- Infringes on intellectual property rights of others
- Contains personal information of others without consent
- Promotes self-harm or suicide
- Is spam, fraudulent, or misleading
5.3 Content Moderation & Enforcement (Zero Tolerance)
- Zero Tolerance: We have a zero-tolerance policy for objectionable content and abusive users.
- Reporting: Users may flag objectionable content or abusive behavior directly within the App.
- Action: Content reported as violating these Terms will be reviewed and removed within 24 hours if found to be in violation.
- Ban Policy: We reserve the right to immediately suspend or ban users who violate these content standards, without prior notice.
6. Intellectual Property
6.1 App Ownership
The App, including its design, code, features, and functionality, is owned by Justin Sun and is protected by copyright, trademark, and other intellectual property laws.
7. Prohibited Uses
You agree not to:
- Use the App for any illegal purpose
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's operation
- Use automated systems (bots) to access the App
- Reverse engineer, decompile, or disassemble the App
8. Privacy
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.
9. Third-Party Services
The App may integrate with third-party services (including but not limited to Firebase and Apple Services). Your use of these services is subject to their respective terms of service and privacy policies.
10. Apple-Specific Terms
10.1 App Store Agreement
These Terms are between you and Justin Sun, not Apple. Apple is not responsible for the App or its content.
10.2 Warranty & Support
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable). Apple will have no other warranty obligation whatsoever with respect to the App.
10.3 Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
10.4 Third Party Beneficiary
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; OR (C) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
13. Indemnification
You agree to indemnify and hold Justin Sun harmless from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or relating to your use of the App, Your Content, or your violation of these Terms.
14. Termination
We may suspend or terminate your access to the App at any time, with or without cause or notice, for any reason, including if you breach these Terms. You may stop using the App at any time by deleting it.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the modified Terms.
16. Dispute Resolution
16.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
16.2 Jurisdiction
You agree that any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Georgia.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings.
